THE CAS AD HOC DIVISION DOES NOT HAVE JURISDICTION TO ENTERTAIN THE APPEAL FILED BY TATIANA DEBIEN (FRA)
Paris, 2 August 2024 - The CAS Ad hoc Division for the Paris 2024 Olympic Games has issued its decision in the following matter:
TAS OG 24/10 Tatiana Debien c. United World Wrestling (UWW) & International Olympic Committee (IOC)
The CAS Panel appointed to decide the application filed by French wrestler Tatiana Debien (the Applicant) against the decision issued by the International Olympic Committee (IOC) on 27 July 2024 (the Challenged Decision) in which her request for an additional quota place for France in 53kg women's wrestling was rejected, has ruled that it does not have jurisdiction to entertain the matter. The dispute, if any, arose at the latest on 10 July 2024, when UWW published the attribution of the quota places. As a consequence, the case could not be reviewed on the merits.
The Panel of arbitrators, composed of Prof. Philippe Sands KC (GBR/FRA/MRI), President, Ms Raphaëlle Favre Schnyder (SUI), and Mr Hamid Gharavi (IRI/FRA), ruled that it did not have jurisdiction. Due to the urgency of the matter, only the operative part of the award was notified; the full award with grounds will be published at a later date.
The Applicant contested the regularity of the qualifying phase of the wrestling competition for the Olympic Games Paris 2024, alleging its non-compliance with the Olympic Charter and sought a ruling from the CAS Ad hoc Panel annulling the Challenged Decision and ordering the allocation of an additional quota for women's wrestling 53kg in favour of France.
